Please read these Terms of Use and Purchase (“Terms”) carefully before using this website or purchasing any product or service offered through it.

This website, including fixthe20.com and any related websites, applications, diagnostic tools, products, programs, materials, or services operated by Most4u LLC (“Company,” “we,” “us,” or “our”), is referred to collectively as the “Site.”

By accessing or using the Site, creating an account, completing a diagnostic, or purchasing a product or service, you agree to these Terms. If you do not agree with these Terms, please do not use the Site or purchase our products or services.

1. USE OF THE SITE AND MATERIALS

The Site and the materials made available through it are intended primarily for business owners and other authorized users seeking to evaluate and improve their businesses.

Subject to your compliance with these Terms, the Company grants you a limited, non-exclusive, non-transferable, and non-sublicensable license to access and use the Site and purchased materials for your own personal or internal business purposes.

You may use and adapt scripts, checklists, templates, procedures, forms, worksheets, and similar implementation materials within your own business where such use is reasonably intended by the material.

You may not resell, redistribute, publish, sublicense, share, reproduce for others, commercially exploit, or make the Company’s proprietary materials available to third parties except with our prior written permission.

2. INTELLECTUAL PROPERTY

Unless otherwise stated, the Site and its contents are owned by or licensed to the Company and are protected by applicable copyright, trademark, and other intellectual-property laws.

Company materials include, without limitation:

FixThe20 diagnostic questions and methodology;

scoring systems and evaluation methods;

reports and recommendations;

frameworks and processes;

videos and training materials;

scripts, checklists, templates, forms, worksheets, and SOPs;

implementation guides and resources;

graphics, photographs, artwork, audio, and written materials;

software, applications, website design, code, and functionality; and

Company names, logos, trademarks, and branding.

Purchasing access to a product or program does not transfer ownership of any Company intellectual property to you.

Except for the internal-use rights specifically granted in these Terms, no Company material may be copied, reproduced, distributed, sold, licensed, published, transmitted, or used to create a competing product or service without prior written permission.

3. ACCOUNT AND ACCESS

Where an account or login is provided, access is intended for the purchaser or authorized user only.

You agree not to share your username, password, login credentials, or paid access with unauthorized individuals.

The Company may suspend or terminate access where we reasonably believe an account is being shared, misused, used fraudulently, or used in violation of these Terms.

4. FIXTHE20 DIAGNOSTIC

FixThe20 is designed to help identify business processes, activities, practices, and areas that may warrant additional attention.

Diagnostic results, scores, estimates, priorities, and recommendations are based in part upon information provided by you. The usefulness and accuracy of the results therefore depend upon the completeness and accuracy of the information submitted.

The diagnostic is intended to assist with business evaluation and decision-making. It is not a guarantee that every issue affecting a business will be identified, nor does it guarantee that implementing a recommendation will produce any particular financial or operational result.

You remain responsible for evaluating whether a recommendation is appropriate for your particular business.

5. EDUCATIONAL AND BUSINESS INFORMATION

Information provided through the Site and FixThe20 is intended for educational and general business purposes.

Nothing provided through the Site constitutes legal, accounting, tax, investment, financial, employment, insurance, engineering, safety, or other regulated professional advice.

Where professional advice is appropriate for your circumstances, you should consult a qualified professional.

6. RESULTS AND EARNINGS DISCLAIMER

Any examples, financial figures, business improvements, savings, revenue opportunities, or results discussed on the Site or within FixThe20 are provided for illustrative and educational purposes only.

Examples may be based upon our experience, client situations, hypothetical examples, industry assumptions, or reasonable estimates.

They are not a promise, representation, or guarantee of what you will achieve.

Your results depend upon numerous factors, including your existing business, market, pricing, customers, employees, systems, competition, experience, implementation, decision-making, and effort.

Some businesses may experience substantial improvement. Others may experience limited improvement or no measurable improvement.

The Company does not guarantee increased revenue, profits, savings, customers, business value, efficiency, or any other specific result.

All business activity involves risk, and you remain responsible for your business decisions and results.

7. CALCULATORS AND ESTIMATES

Any calculators, projections, opportunity estimates, lost-revenue calculations, potential-savings figures, or similar tools provided by the Company are estimates only.

They are intended to illustrate possible business impact based upon assumptions and information supplied by you.

Actual results may differ significantly.

Such calculations should not be considered audited financial information, financial advice, or a guarantee of future performance.

8. PURCHASES AND PAYMENT

Prices for products and services are displayed at the time of purchase and are subject to change.

By submitting payment information, you represent that you are authorized to use the payment method provided and authorize the Company and its payment processor to charge the applicable amount.

Any additional implementation work, consulting, customization, or services not expressly included with your purchase may require a separate fee and may be subject to a separate agreement.

9. REFUND GUARANTEE

Unless a different written refund policy is expressly stated on the applicable checkout page, qualifying purchases of FixThe20 are covered by a 7-day money-back guarantee.

If you determine that FixThe20 is not right for you, you may request a refund within seven (7) calendar days of your original purchase.

Requests received after the applicable refund period may be denied.

Upon issuance of a refund, your access to the applicable paid product and associated materials may be terminated.

The refund policy does not apply to separately purchased consulting, implementation work, custom services, or other services once those services have begun unless expressly stated otherwise in writing.

10. LIFETIME ACCESS

Where a product is sold with “Lifetime Access,” the term refers to your access to the purchased digital product for the commercially reasonable life of that product while it continues to be operated and supported by the Company.

Lifetime Access does not mean the lifetime of the purchaser or guarantee that a particular website, platform, technology, or delivery system will remain available indefinitely.

The Company may change the platform, format, hosting provider, delivery method, organization, or presentation of the materials.

If the Company permanently discontinues a product, we may, where reasonably practical, provide another means of accessing the principal materials before access ends.

Lifetime Access does not include future consulting, implementation services, custom work, one-on-one assistance, or newly created products unless those items are expressly stated as included with the original purchase.

11. UPDATES AND FUTURE MATERIALS

The Company may update, revise, add to, remove, reorganize, or replace materials at its discretion.

A purchase does not automatically include every future product, program, service, module, implementation package, consulting service, or resource created by the Company unless expressly stated otherwise.

12. CUSTOMER INFORMATION AND SUBMISSIONS

You may provide information concerning your business when completing diagnostics, forms, questionnaires, support requests, or other interactions with the Company.

You retain ownership of information and materials that belong to you.

You grant the Company permission to use information you submit as reasonably necessary to provide the Site, diagnostic, reports, recommendations, customer support, purchased products, and related services.

You represent that you have the right to provide any information, photographs, documents, customer information, employee information, or other materials you submit.

You should not submit confidential information belonging to another person or company unless you are authorized to do so.

Our collection and handling of personal information may also be governed by our Privacy Policy.

13. THIRD-PARTY PRODUCTS AND SERVICES

The Company may mention, recommend, link to, or integrate with third-party software, products, websites, or service providers.

We do not control third-party products or services and are not responsible for their availability, performance, security, pricing, policies, or actions.

You are responsible for evaluating whether any third-party product or service is suitable for your business.

The Company may occasionally receive referral, affiliate, or other compensation from certain providers. Where required, such relationships will be disclosed.

14. NO WARRANTIES

To the fullest extent permitted by law, the Site and its content, products, diagnostic tools, recommendations, and digital materials are provided on an “as is” and “as available” basis.

The Company makes no warranty that the Site will operate without interruption or error, that every recommendation will be appropriate for every business, or that use of the Site will produce a particular result.

Nothing in these Terms excludes any warranty or right that cannot legally be excluded.

15. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, the Company and its owners, officers, employees, contractors, affiliates, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the Site, products, services, recommendations, or materials.

This includes, without limitation, lost profits, lost revenue, lost customers, lost data, business interruption, or losses resulting from business decisions made using information provided through the Site.

To the fullest extent permitted by law, the Company’s total liability relating to a particular purchase will not exceed the amount you actually paid to the Company for the product or service giving rise to the claim.

16. YOUR RESPONSIBILITY FOR IMPLEMENTATION

You are responsible for deciding whether, when, and how to implement any recommendation provided through FixThe20.

Business circumstances vary. A strategy that works well for one company may not be appropriate for another.

You are responsible for complying with all laws, regulations, licensing requirements, employment rules, safety standards, contracts, and industry requirements applicable to your business.

17. PROHIBITED USE

You may not use the Site or Company materials to:

violate any law or regulation;

infringe another party’s intellectual-property rights;

gain unauthorized access to systems or accounts;

distribute malware or harmful code;

misrepresent your identity;

interfere with operation of the Site;

scrape or systematically extract proprietary Company content for resale or competing commercial use;

train or develop a competing commercial product substantially from Company proprietary materials; or

reproduce or distribute Company materials beyond the rights granted under these Terms.

18. TERMINATION

The Company may suspend or terminate access to the Site or paid materials if you materially violate these Terms, engage in fraud, misuse the Site, improperly distribute Company materials, or engage in conduct that threatens the operation or security of the Site.

Termination for violation of these Terms does not automatically entitle you to a refund.

19. LINKS TO OTHER WEBSITES

The Site may contain links to websites operated by third parties.

Such links are provided for convenience and do not necessarily constitute endorsement.

The Company is not responsible for the content, policies, security, products, services, or practices of third-party websites.

20. CHANGES TO THESE TERMS

The Company may update these Terms from time to time.

The current version will be posted on the Site with an updated revision date.

Changes will apply prospectively from the date they are posted unless otherwise required by law.

Material changes affecting an existing paid purchase will not retroactively eliminate rights expressly granted as part of that purchase.

21. SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

22. NO WAIVER

Failure by the Company to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.

23. SEPARATE AGREEMENTS

These Terms govern use of the Site and purchases made through it unless a separate written agreement between you and the Company expressly provides otherwise.

Consulting, implementation, customized services, licensing arrangements, or other engagements may be governed by additional agreements. Where there is a direct conflict, the applicable separate written agreement will control with respect to the services covered by that agreement.

24. GOVERNING LAW

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.

To the extent a dispute is properly brought in court, the parties consent to jurisdiction and venue in the state or federal courts located in North Carolina, subject to applicable law.
